    Day 1

    Papeete, Tahiti Island - Embarkation (Docked)

    Arrive to Papeete, and meet your included transfer to the ship for embarkation. Embarkation is from 4:00 – 5:00 PM, and the ship sets sail at 6:00 PM. No tours are scheduled for today in Papeete.

    Capital of French Polynesia, the city of Papeete is on the north-west coast of the island of Tahiti. You’ll find a relaxed atmosphere here, where urban buzz combines with the legendary laid-back Polynesian lifestyle. Culture is not lacking. You can enjoy sites narrating the history of the archipelago, including the colonial cathedral and the Maison de la reine Marau. The Vaipahi public gardens will win you over by their abundant plant-life. The large municipal market offers local specialties: fresh fruit, spices and all kinds of fish abound on their stalls.     Moorea Island (Anchored)

    A part of the Windward Island archipelago just to the west of Tahiti, famous Mo’orea will leave you with a series of unforgettable images and memories. Bask on its heavenly beaches, enjoy a dip in the turquoise waters of its lagoon, and soak up its luscious vegetation and the heady flowers that carpet the inland areas. Get the most out of this natural gem with a trip to the Mo’orea Belvedere.     Located in the Tuamotu Archipelago, Makatea (from the Polynesian words for rock, “maka”, and white, “tea”) is a raised coral atoll belonging to the Palliser group of islands in French Polynesia. Tikehau, the nearest atoll, is 75 km south and Tahiti is some 200 km north-east. Its cliffs covered in lush vegetation overlooking the ocean will take you away for a suspended moment.     Rangiroa, Tuamotu Islands (Anchored)

    A secluded atoll in the Tuamotu Archipelago, Rangiroa, meaning “vast sky” in Polynesian, is very aptly named. The lagoon of the largest atoll in Polynesia is reminiscent of the heavens, imprisoned by hundreds of islets formed by sand that veers from immaculate white to pink. But the beauty of Rangiroa, classed by Captain Cousteau as one of the most beautiful diving spots in the world, is most evident in its underwater life: you will have the occasion of admiring all the richness of the site on a snorkeling tour or on a glass-bottom boat tour.     In the north-west of the island of Ua Pou, the third-largest of the Marquesas Islands, Hakahetau captivates with its wild splendour and the calmness that reigns over its legendary lands. With a luxuriant valley sheltering a tropical forest on one side and a paradisiacal bay of crystal-clear waters on the other side, the former capital of the island is a perfect spot for nature lovers. Here, like across the entire island, the inhabitants live primarily off fishing, farming and crafts: their wooden and stone sculptures are renowned. (Breakfast, Lunch & Dinner)

    Hatiheu, Nuku Hiva Island (Anchored)

    Entering Hatiheu Bay, you will quickly make out the statue of the Virgin, which, standing more than 300 metres high, overlooks this beautiful little village. Located on the north of Nuku Hiva Island, this locality is dominated by impressive basalt pitons. In the past, the fear of tsunamis and attacks from other clans led the tribes to settle in the interior of the valleys. As a consequence, many archaeological sites remain preserved and make for interesting excursions. You will find many of the ceremonial plazas, called tohua, notably those of Kamuihei and Hikokua where you will be able to observe several reconstructed traditional houses.     Taiohae, Nuku Hiva Island (Anchored)

    Taiohae Bay welcomes you in a sumptuous setting. Your ship will drop anchor a few kilometres from the black sandy beaches, nestled between majestic valleys. You will find yourself in the middle of the main village on the island of Nuku Hiva. You can follow the footpaths on foot or in an all-terrain vehicle. From the top of the hill of Mount Muake, a breathtaking panorama allows you to clearly identify the rocky islands that emerge on either side of the bay. Further on, the site of Piki Vehine shows its tikis, sacred statues used for religious practices. In addition, do not miss the Notre Dame des Marquises cathedral. Its distinguishing feature is that is was built using stone taken from the six Marquesa Islands. (Breakfast, Lunch & Dinner)

The archaeological site of Meae Lipona, one of the most beautiful places for admiring the famous “tiki” statues, ancient religious stone sculptures depicting men, is itself hidden at the heart of a dreamlike décor. The waters of the nearby stream babble as the only peak in the valley keeps watch from above. The stories and myths you hear will take on a whole new meaning here. Fall under the magical spell of Polynesia.

    Hanaiapa, a peaceful jewel in the north of the island of Hiva Oa, captivates visitors with its authenticity and serenity.     Your ship will take you to Omoa, a peaceful fishing village far from all civilization, nestling in a magnificent bay on the island of Fatu Hiva. In the valley, you will be able to spot some tohua, former sacred sites, as well as the many burial caves lost in the island’s abundant tropical forest. During your port of call, you’ll be able to discover the Maison Grelet, a museum that houses remarkable wooden sculptures and local works of art. Right in front of you, the village’s artisans will demonstrate how they make tapa, a bark cloth obtained through the technique of beating layers of wood, and explain the manufacturing processes of umu hei, a bouquet garni made from a delicious mix of fragrances.

    Grandiose, striking and powerful, the Marquesas are more rugged than their Polynesian sisters. The archipelago’s charm lies in its extraordinary wild beauty: waterfalls flowing down vertiginous peaks, jagged cliffs sinking into the indigo sea, and lush vegetation. On the island of Fatu Hiva, you’ll discover the famous Hanavave Bay, considered to be one of the most beautiful in the world. Make the most of your free time to stroll among the houses and gardens of the village. Its inhabitants, specialised in the manufacture of tapa (bark cloth), will welcome you with ukulele music and traditional songs.     Located on Tahuata, the smallest of the inhabited Marquesas Islands, the village of Hapatoni will open its doors to you. A road built in old stones will lead you from the seashore to the village cathedral. You will also find a craft centre presenting various sculptures and engravings in bone or wood. Marquesan art is, in fact, recognised all over French Polynesia. Further on, vegetation takes over, inviting you to walk among its beautiful green valleys.     When should I schedule my flights?

    Arrival: You should schedule your flights to arrive to Faa’a International Airport in Papeete (PPT) on or before October 3, 2027 Embarkation will commence at approximately 3:00pm.

    Departures: Guests may disembark on October 17, 2027 from 7:30am in Papeete. You should schedule your flight to depart from Faa’a International Airport in Papeete (PPT)on October 17, 2027 at noon or later.

    What are the passport and visa requirements?

    All guests should ensure their passports are valid for a minimum of 6 months from the start of this trip.

    Entry visas are not required for US Citizens visiting French Polynesia for tourism stays of less than 90 days. Citizens of other countries should check with their home country consulate or embassy for entry requirements.

    What arrival and departure transfers are included?

    Arrival transfers are provided for flight arrivals, from the Faa’a International Airport in Papeete (PPT) or to your independently booked pre-cruise hotel. If you book a pre-cruise hotel the transfer will be provided to that hotel. The further transfer to the ship will need to be arranged independently at your own expense.

    Departure transfers are provided from the ship to Faa’a International Airport in Papeete (PPT) or a local hotel after which no further transfers will be provided.

    Contact our team or your travel agent to ensure arrangements outside of these arrival and departure transfers will be included. Booked guests should provide their arrival and departure details 45 days prior to the trip to ensure transfer availability.

     

    What if I have dietary requirements (allergies, religious restrictions, or preferences)?

    We will make every effort to accommodate special dietary requests. Please inform our office at least 45 days prior to departure of these requests.

    What are pre-paid gratuities?

    Gratuities are customary expressions of appreciation for a job well done. It is our goal to ensure that the service you receive is as wonderful as the sites you visit. Gratuities for the included portions of this program have been prepaid. At your own discretion, you may choose to provide additional tips.

    Is there a dress code?

    You are on vacation, so the last thing we want to impose is a dress code.  Be as dressed up or down as you see fit as long as you’re comfortable. However, when dinning in the ship’s main dining room, long pants and a shirt or collared T shirt are required. Be sure to dress appropriately for changeable weather.

    Are excursions included?

    Yes, generally one excursion per port is included as part of the cruise fare.

    Will there be smoking areas?

    The comfort and safety of our guests is our first priority. Smoking is only permitted in designated areas. On board the cruise, smoking is not permitted in the cabins or enclosed, public areas. We request that you refrain from smoking during excursions.

    What weather can I expect from this trip?

    In October, average temperatures in French Polynesia can reach highs in the mid 80’s, and lows in the mid 70’s degrees Fahrenheit.

    Expect a mix of sunshine and occasional showers. October marks the transition from the dry season to the wetter months, so humidity begins to rise and cloud cover increases slightly.

    It’s a great time to visit for warm waters, lush landscapes, and fewer crowds than peak season.

    2027 Luxury French Polynesia Cruise: Tahiti, Marquesas and Society Islands – Terms & Conditions

    Thank you for choosing Brand g for your vacation. The cruise portion of this vacation is provided by COMPAGNIE DU PONANT (Ponant). To ensure that you understand the conditions of your particular vacation, please read the following policies and procedures completely. All policies and procedures are subject to change at any time at Brand g’s sole discretion without notice. Any and all information contained herein is in effect at the time of printing and is subject to change at any time.

    Information contained in this document does not form part of any offer or contract. The transportation of guests and baggage on Ponant vessels is provided solely by Ponant and is governed by the terms and conditions printed on the Passage Contract. The Passage Contract is included below, and contains complete and important information regarding cancellations, itineraries, Ponant’s liability, health and immigration requirements, and other relevant terms and conditions. The terms and conditions of the Passage Contract will apply to persons who have booked a cruise regardless of whether or not they have embarked the vessel. Please read your Passage Contract carefully. To the extent that any of the information in the brochure conflicts with the terms of the Passage Contract, the terms and conditions contained in the Passage Contract shall control.

    Itinerary arrival and departure times are always subject to change without notice. Brand g Vacations and Ponant reserve the right to cancel, alter, advance, postpone or substitute any scheduled sailing or itinerary, substitute another vessel for the scheduled ship, or substitute or cancel scheduled ports of call, which, in its sole judgment and discretion, is justified for any reason, and to do so without liability for any loss whatsoever to guests as a result of said change(s). Additionally, Ponant reserves the right to cancel reservations and bookings in the event of a full-ship charter, whether or not a deposit or full payment has been received, and in such event, Ponant’s only liability will be to refund to the guest the amount it has received.

    Ponant makes arrangements for transportation, other than cruise passage, only as a booking agent. Ponant’s responsibility does not extend beyond the vessel. In arranging for the transportation of guests to and from the ship, Ponant does so with independent contractors. Ponant is not responsible for incidents such as airline cancellations, re-routings or any disruption of scheduled services or accommodation, or lost luggage.

    All schedules, fares, and terms and conditions listed at www.brandgvacations.com are effective as of September 2025 and supersede any schedules, prices, and terms and conditions previously published.

    All fares including land and hotel, are capacity controlled, subject to change at anytime without notice and do not guarantee availability. All are subject to change and/or cancellation without notice.

    Travel documents will not be dispatched until full and final payment and passenger Contact Information has been received by Brand g Vacations and cleared. For purposes of this Agreement, Contact Information shall mean a passenger’s full name, passport number, address, telephone number (land and mobile), electronic mail address and emergency contact information and any other information as requested. We must be able to reach each passenger’s emergency contact at any time of day. We must, therefore, be provided with all information to allow us to do so (such information should include the name, address, electronic mail address (if available) and phone number (including a cell phone number if available) of a parent, guardian, spouse, domestic partner, or other person to contact in the event of an emergency. No guest will be allowed to participate in this vacation until we have received all information.

    Cruise Tariff
    2027 fares cover certain services including: accommodations, shore excursions, onboard meals, beer, wine, select spirits, and entertainment aboard ship. All fares are quoted in US dollars, are per guest and based on double occupancy. Not included in your program tariff are: optional shore excursions, meals taken ashore during the cruise, fuel surcharges, laundry, purchases from the ship boutique or any item or service of a personal nature such as medical care, massages and spa treatments.

    Travel Professionals
    Travel agents are considered to be the agent of Passenger and not of Carrier. Carrier is not liable for any representation, act or omission of Passenger’s travel agent. Passenger’s cruise fare is not considered paid until Carrier receives full payment, and the amount thereof is subject to change at any time prior to Carrier’s receipt of payment. Passenger shall at all times remain liable to Carrier for the price of passage. Carrier reserves the right to refuse embarkation if all charges and surcharges have not been paid in advance of departure.

    Deposit/Final Payment
    All payments will be processed by Brand g Vacations. To reserve your cruise, a $3,000 per person deposit is required at the time of booking, a second payment of $3,500 per person is required 365 days prior to departure (07/26/2026), a third payment of $3,500 per person is required 280 days prior to departure (10/19/2026) and full payment is due no later than 120 days prior to departure (03/28/2027). Guests will not be permitted to change travel agents once final payment has been received. Final documentation will be issued after receipt of final payment and approximately 30 days prior to sailing. All reservations are subject to cancellation if payments are not received by the due date and are guaranteed only when paid in full 120 days prior to sailing. Reservations made within 120 days of sailing require full payment within seven days of booking or sooner, as specified by Brand g Vacations. Payments may be made by AMEX/VISA®/ MasterCard® or DISCOVER®.

     Cancellations/Refunds
    Should you find it necessary to cancel your reservation or any component thereof, you or your travel professional are required to contact Brand g Vacations directly by telephone as well as submit your cancellation in writing. Refunds are subject to the schedule below regardless of suite/cabin resale and cancellation charges may not be converted to future cruise credits:

    Health and Medical Requirements

    All guests are required to report in writing to Brand g Vacations at the time their reservation is made:

    1. Any physical or mental condition that may require medical or professional treatment or attention during the voyage
    1. Any condition that may render the guest unfit for travel, or that may require special care or assistance
    2. Any condition that may pose a risk or danger to the guest or anyone else on board the ship
    3. Any condition that may require oxygen for medical reasons
    4. Any intention or need to use a wheelchair cart, other mobility device

    By booking passage on this program and by boarding the ship, the guest represents and warrants that he/she is physically and otherwise fit to travel, and that the guest will comply at all times with applicable rules and regulations of the ship and orders and instructions of the ship’s officers.

    Brand g and Ponant reserve the right without liability to require a guest to leave the program, or disembark and/or to refuse to board and transport a guest who, in the judgment of Brand g, Ponant or the ship’s Captain, is unfit to travel or may require care beyond that which we reasonably able to provide.

    We strongly recommend that guests are able to navigate the stairs on-board without assistance. Should guests require assistance, they must travel with someone who is able to assist them both ashore and at onboard. Brand g and Ponant are unable to offer special assistance. Please note that wheel-on and/or wheel-off access is not available at ports-of-call.

    Baggage
    You may bring aboard the ship a reasonable amount of clothing and personal effects without charge. Baggage for Ponant guests or guests on our land extension programs must be handled in accordance with regulations of our operators. Baggage exceeding these limitations is subject to the charges as set forth by the individual operators. Airlines are strict with baggage limitations. Guests are encouraged to contact individual airlines for weight limitations.

    All baggage must be securely packed, and properly and clearly labeled. Liquid, fragile, perishable and other articles not suitably packed are transported at your own risk. Ponant and Brand g are not responsible for loss or damage to baggage or any other personal item during air travel or land extension programs.

    Baggage and personal belongings will be taken off the ship upon guest disembarkation. Under no circumstances will baggage be stored onboard without the owner of such baggage being on the vessel. Ponant is not responsible for baggage stored in shore side facilities.

    Under no circumstances may dangerous items (including but not limited to: explosives, firearms, combustible or illegal substances) be taken aboard the ship. We recommend that you hand-carry travel documents (passport, visa, cruise tickets), medications and valuables. These items are the full responsibility of the guest at all times. Ponant shall not be responsible for the loss of, or damage to, such personal items.

    Lost Property
    Brand g may levy a charge for the return of personal items left behind or lost and subsequently found.

    Travel Documents
    All travel documents (air and cruise tickets, passport and medical insurance information) are the guest’s responsibility. It is also the guest’s responsibility to obtain any necessary visas and public health documents for all applicable ports and to comply with all customs requirements. Without the required documents, a guest may be denied boarding and accommodation by Ponant or the guest may be disembarked during the voyage and Brand g Vacations will not make a refund or be otherwise liable to any guest for such denial of boarding or disembarkation.

    In the event that Brand g as a courtesy provides information or advice as to necessary travel documents, visas and medical inoculations, guests are still obligated to verify such information with the appropriate government authorities and Brand g does not warrant or guarantee the accuracy of such information. Please check with the appropriate consulate for specific requirements. Security measures imposed by governments may change from time to time and each guest will be required to comply with them. As a courtesy, we will endeavor to provide each guest with notice of measures that may affect them, but complying with any such requirements is the sole responsibility of each guest. Please consult your travel professional for advice on such requirements to avoid loss of boarding privileges.

    Taxes, Government Fees/Quasigovernment Fees and Fuel Supplements
    Brand g reserves the right to pass through to its guests (including fully paid and deposited guests) any taxes and government fees/quasi-government fees that relate specifically to a guest’s itinerary. “Taxes and Government fees/quasi-government fees” include any and all fees, charges, surcharges, tolls and taxes imposed by governmental or quasi-governmental authorities including, but not limited to, customs fees, per person berth taxes or fees, embarkation and/or disembarkation fees at ports, airline transportation fees, dockage fees, and wharfage fees.

    Ponant reserves the right to charge a per person fuel supplement in the event that the price of increases up to and including the day of embarkation. Ponant may collect any taxes, government fees/ quasigovernment fees and fuel supplement (the “Surcharges”) at the time of booking, prior to sailing or on board the vessel, even if the cruise fare has been paid in full. Surcharges will be invoiced accordingly.

    All fares, and itineraries are subject to change without notice. Additional restrictions may apply. We reserve the right to correct any errors or omissions.

    Our website or promotional materials may contain inadvertent technical or factual inaccuracies and typographical errors. Brand g reserves the right to correct errors and omissions at any time without prior notice, and to cancel any offered product, service, amenity, etc. in the event of any error or omission in the description, including pricing and availability.

    Video / Photographic Release
    You agree to participate in promotional, publicity, or merchandising pictures during this event. You hereby authorize the reproduction, sale, copyright, broadcast and /or distribution of said video, sound recording and pictures without limitations. You further agree and release Brand g, its parent, their representatives and agents from any liability, loss, expense or claims arising from distribution, broadcast, sale or use of your likeness or voice. You certify that you are 21 years of age or over. You may opt out of any promotional videos and pictures; however, Brand g does not guarantee that you will not be included.

    PONANT MARITIME CONDITIONS OF CARRIAGE

    Important notice: These Maritime Conditions of Carriage govern the relationship between Compagnie du Ponant (or “CDP” as defined below) in its capacity as Carrier (as defined below), and the Passenger (as defined below) who participates in a Cruise (as defined below) on a Ship (as defined below) operated by CDP and where the Passenger has purchased such Cruise from a company other than CDP (hereinafter the “Seller”).

    Please read these Maritime Conditions of Carriage (hereinafter the “Conditions”) carefully.

    We would particularly like to draw the Passenger’s attention to the Carrier’s rights to exclude and limit its liability, as well as to the provisions of article 7 below, which set out the time limits and conditions for submitting a claim and initiating proceedings against the Carrier.

    By using the Voucher (as defined below) and/or by boarding the Ship, the Passenger irrevocably and unconditionally accepts all the terms of these Conditions. Where permitted by law, representatives and agents on land and at sea, as well as any person involved in the provision of the service by the Carrier, may enforce and benefit from the terms of these Conditions against the Passenger. If one of the provisions of these Conditions is in breach of a mandatory statutory provision, the said provision will be considered null and void, without this nullity affecting the other stipulations of these Conditions.

    The maritime carriage provided by the Carrier for the benefit of the Passenger starts when the Passenger embarks on the Ship at the port of departure mentioned on the Voucher (as defined below) and ends when the Passenger has disembarked at the port of arrival mentioned on the Voucher or at any other port deemed to be the port of arrival or when the Cruise ends.

    – Definitions

    1.1 “Athens Conventions“: the international convention signed in Athens on 13 December 1974, as amended in 2002 and ratified by France, including the reservation made by France in accordance with the guidelines of the International Maritime Organization.

    1.2 “CDP Health Protocol”: the manifesto drawn up by CDP, including an FAQ, regularly updated and accessible on the website www.ponant.com

    1.3 “Compagnie du Ponant” or “CDP” or the “Carrier”: Compagnie du Ponant, a simplified joint stock company with a sole shareholder, whose registered office is located at 408 Avenue du Prado 13008, Marseille France, registered in the Marseille Trade and Companies Register under number 344 497 011, and with the Atout France Register under number IM013120040, and member of the Entreprises du Voyage.

    1.4 “Conditions” or “Maritime Conditions of Carriage“: The present document which contains the terms and conditions under which the Carrier undertakes to carry the Passenger between the ports mentioned on the Voucher.

    1.5 “Cruise“: the cruise on which the Passenger travels in accordance with the Voucher

    1.6 “Expedition Cruise”: An exploratory Cruise that includes inflatable dinghy trips and naturalist guides.

    1.7 “Itinerary“: the itinerary of the Cruise as set out in the Voucher as planned and agreed between CDP and the Seller.

    1.8 “ Passenger” or “Passengers”: Any person whose name and contact details appear on the Voucher, and who is participating in the Cruise on the Ship operated by CDP, even if they purchased that Cruise from the Seller.

    1.9 “Prohibited Items“: as defined in paragraph 4.10.

    1.10 “Ship” or “Ships”: the ship operated by CDP used for the performance of cruises, and its annexes.

    1.11 “Seller“: the natural or legal person who has sold the Cruise – and in his own name – to the Passenger, with or without additional services such as land, sea and air transport or activities (e.g. land excursions).

    1.12 “Voucher“: document required to embark on the Ship and by which CDP undertakes to provide the Passenger with the sea carriage in accordance with these Conditions and in accordance with the Itinerary.

    – ACCEPTANCE AND APPLICATION OF THE MARITIME CONDITIONS OF CARRIAGE

    2.1 By accepting or using the Voucher, and in any event by boarding the Ship, the Passenger accepts these Conditions.

    2.2 These Conditions apply notwithstanding the between the Passenger and the Retailer and may not be modified by the Passenger or the Retailer.

    – PROTECTION OF PERSONAL DATA

    In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, on the protection of personal data, the Passenger has the right to access, rectify, erase, portability, oppose, limit processing or not be subject to an automated individual decision, including profiling, to personal information concerning him/her and that CDP,  Data Controller, may be required to collect for the purposes of its activity and the performance of the services it provides, in particular. To find out or exercise the rights over their personal data, the Passenger can contact the Data Protection Officer by email: [email protected] or consult CDP’s personal data protection policy on the www.ponant.com website.

    – CONDITIONS OF BOARDING, DISEMBARKATION, AND CARRIAGE

    4.1 Passengers must present themselves for boarding on the conditions set out herein, in accordance with the provisions of the Voucher and at least two (2) hours before the Ship’s scheduled departure time.

    4.2 The Voucher is personal and nominative. Passengers may not transfer their Voucher to a third party for any reason whatsoever.

    4.3 All Passengers must be in possession of a valid passport or, where applicable, an identity card, valid for 6 months after the date of their return, as well as any visas and vaccination certificates that may be required in the ports of departure, of call and arrival of the Ship. Each Passenger is personally responsible for complying with all legal and regulatory requirements prior to departure. The Carrier may refuse boarding or disembarkation to Passengers who do not present a document authorizing them to disembark at the point of arrival and at the scheduled stopovers. The Passenger is invited to consult the following websites: https://www.ponant.com/formalites,  www.diplomatie.gouv.fr and www.pasteur.fr.

    4.4 a) Each Passenger certifies that he/she is fit to travel at sea and that his/her state of health or behaviour will not cause harm to other Passengers or to the proper operation of the Ship on the Itinerary. If the Passenger’s state of health is likely to restrict his/her ability to follow the planned Itinerary or to benefit from the agreed service or to disrupt the smooth running of the Cruise or endanger the safety of other Passengers or crew members, he/she must notify the Seller and/or the Carrier. If required, each Passenger will produce a medical certificate attesting to his/her fitness to travel upon request. Passengers agree to complete health questionnaires (The latest version is available on the following page). Responses to these questionnaires will be treated confidentially and will not be communicated for reasons other than medical reasons related to the Cruise and will be processed in accordance with Compagnie du Ponant’s Data Protection Policy and to the applicable data protection regulations. The Passenger who has not reported to CDP or the Ship’s doctor a particular state of health likely to affect the performance of the Cruise or the services provided for in the Voucher will not be able to seek CDP’s liability in this respect. Medical consultations, care and medication on land or on-board Ships are the responsibility of the Passenger. All Passengers must ensure that they are covered by appropriate medical insurance coverage.

    1. b) The Passenger must present himself at boarding under the conditions set out in the CDP Health Protocol, which has been communicated by the Seller and accepted by the Passenger before the purchase of the Cruise and which may be updated and communicated again at the request of the Passenger before departure, and which he must respect throughout the Cruise. CDP also invites the Passenger to regularly review updates to the health protocol on the CDP website (https://www.ponant.com/formalites/).
    2. c) If, on the day of boarding, the Passenger is not in compliance with one of the boarding conditions set out in CDP’s health protocol, the Seller and/or CDP and/or the Ship’s Captain are entitled to refuse the boarding. In this case, the Passenger is deemed to have cancelled his/her Cruise through his or her own actions.

    4.5 Disembarkation at certain ports may be difficult or even impossible for Passengers with reduced mobility, particularly when disembarking in a rowboat and/or leaving in an inflatable boat. Passengers using a wheelchair must be equipped with their own wheelchair and must be accompanied by a person capable of assisting them. Each Passenger must be autonomous or accompanied by a person capable of always providing all necessary assistance during the performance of the Cruise.

    4.6 The Carrier and/or the Ship’s Captain reserves the right to refuse access to Passengers who have failed to inform the Carrier and/or Seller of such disabilities or need for assistance if such Passenger’s medical condition is not compatible with the applicable safety rules or if the design of the Ship and/or the port infrastructures and equipment, including the port terminals, make it impossible for the Passenger concerned to embark, disembark or be transported under safe or operationally feasible conditions. Passengers are informed that the sailing yacht “LE PONANT” and the catamaran “SPIRIT OF PONANT” are unfortunately not accessible to people with reduced mobility or in wheelchairs.

    4.7 While on board the Ship and throughout the Itinerary, Passengers must comply with the on-board rules and regulations set by the Carrier. The Passenger is required to attend all safety demonstrations and explanations that may be organized on board, and to follow the crew’s instructions at all times.

    4.8 The Carrier and/or the Captain may, if they consider it necessary, refuse to embark any Passenger who does not comply with the conditions of entry into the country of the ports of departure, call, destination or whose presence on board could cause prejudice to the comfort, health or safety of the other Passengers, the crew, the laws and regulations of the ports visited by the Ship, or who could make the Carrier responsible for their maintenance, defense or repatriation. For these reasons, the Carrier and/or the Captain may also decide to take the following appropriate measures: 1) refuse to embark the Passenger(s) in any port visited by the Ship, 2) disembark the Passenger(s) in any port visited by the Ship, 3) transfer the Passenger(s) to another Ship, 4) confine the Passengers on board, in their cabin or in a cabin of the on-board medical service, and/or 5) require medical care by the on-board doctor.

    4.9 As part of the control of an epidemic risk, the Carrier and/or the captain, and/or any local health authority, require the Passenger to complete a health questionnaire, as well as, where applicable, a screening test before or at the time of embarkation or disembarkation, including during stopovers. The cost of screening tests is borne by Passenger.

    4.10 The safety of Passengers and crew is an absolute priority for the Carrier. The goods and objects whose contents may threaten the health and safety of persons and property, damage or pollute the Ship, flammable, explosive, corrosive, dangerous or odorous materials, materials liable to leakage, objects whose import is prohibited or which do not comply with customs or police regulations,  and, in general, all goods and objects other than those intended for the Passenger’s personal use are prohibited on board and in luggage. In particular, the items listed below are notably prohibited on board Ships (hereinafter the “Prohibited Item(s)”): prohibited narcotics/drugs (including marijuana prescribed for medical purposes and any other accessory associated with drug use; this also applies to hookahs); all firearms, including replicas, imitations, neutralized firearms, starter pistols and their components; BB or pellet guns or rifles; other projectile weapons or objects resembling or similar to firearms (e.g. paintball guns); all types of ammunition or replicas for the above items; all types of explosives, components (e.g. detonators) including replicas of explosives or devices; fireworks, flares and pyrotechnic products; martial arts weapons (e.g. shuriken stars, nunchaku); knives longer than 3 cm/1.2 inches; cutlass razors; swords, Sgian Dubh or kirpans; harpoons or harpoon guns; crossbows, crossbow bolts and arrows; blunt weapons such as brass knuckles, maces, telescopic batons, flails or nunchakus; items containing incapacitating substances (e.g. gas pistols, tear gas canisters, tear gas, phosphorus, acid and other chemical substances that can mutilate or incapacitate); restraining devices (e.g. handcuffs, leg or head restraints); flammable substances or dangerous chemicals (e.g. petrol, methylated spirits, paint thinner, lighter fluid, etc.); any other item manufactured, diverted or used as an offensive weapon; stun devices (Tazers and stun guns); large batteries with a capacity of more than 100Wh (e.g. spare batteries and external back-up batteries); items carried on board the ship and not supplied by the company, containing any heating element (e.g. immersion heaters, electric blankets, irons, kettles, coffee machines with hot plates, rice cookers, etc.); any autonomous or remote-controlled flying object, toy or drone; hoverboards, scooters, electric scooters or Segways; compressed air cylinders/tanks, including diving cylinders, propane cylinders and large aerosol canisters; emergency position-indicating radio beacons (EPIRBs), amateur radios, satellite telephones, transformers, lasers and laser pointers; all types of radio or telephone jamming equipment; Samsung Note 7; candles.

    Passengers will be liable for any injury, loss or damage suffered because of the presence of Prohibited Items in their luggage or cabin and will hold the Carrier harmless against any actions that may be brought against them because of the presence on board or during embarkation or disembarkation of the Prohibited Items. The Prohibited Items may at any time and in any place be confiscated, unloaded, destroyed or rendered harmless by the Carrier and/or the Captain and/or crew, without compensation and notwithstanding the payment by the Passenger of any destruction costs. In case that a Prohibited Item is deemed to be illegal, the relevant authorities will be notified.

    Passengers are also advised to avoid charging their battery-operated devices on board their vehicle overnight.

    4.11 Each Passenger may bring on board the Ship a reasonable quantity of clothing and personal effects free of charge. Passengers must, however, consider any limitations on the number, size and weight of luggage that may be imposed by the airlines and other means of transport used by Passengers. All luggage must be securely packed and clearly labelled with the Passenger’s full name, the name of the Ship, the Passenger’s cabin number and the Ship’s departure date.

    4.12 The Passengers agree on simple request and without delay, to give free access to their cabin, luggage and personal effects to CDP and/or to the officers of the crew, as well as to the customs, health and/or administrative authorities of the countries of call or of the flag State.

    4.13 Passengers must look after their luggage and personal effects throughout the duration of the Cruise, including the stay on board and during embarkation, transshipment, and disembarkation operations. CDP declines any responsibility for luggage left unattended by the Passenger and for which the Passenger has not taken all necessary precautions to avoid theft, loss or damage.

    CDP is not responsible for the loss or theft of money, cash, negotiable instruments, jewelry and other valuables that the Passenger has not declared as valuables, entrusted to the crew with a descriptive inventory including estimates, and for which the Passenger has not paid the corresponding proportional custody fees.

    CDP will only be liable within the limits of Article 1953 of the French Civil Code and the provisions of the necessary deposit. The Passenger can declare the value of fragile items, jewelry, watches, money, cash, computers and other electronic equipment, mobile phones or any other precious item and entrusting them on board or depositing them in the safe provided in the cabin, together with a descriptive and estimated inventory, for which the Passenger may be required to pay a corresponding custody fee.

    4.14 CDP will not be liable for any damage caused to photographic or electronic equipment, telephone or cameras lost or damaged during the performance of the Services, whether on board the ship or its annexes or during embarkation or disembarkation operations, nor for any damage caused to objects that have fallen into the water.

    4.15 Animals, except for service or medical assistance animals subject to the conditions of access on board by their owners, are prohibited on board Ships and are not allowed to embark.

    4.16 Passengers are civilly and criminally liable for any damage that they cause directly or indirectly to the Carrier, to other Passengers or to third parties. They will be solely liable for any fine or penalty imposed on them by the competent authorities.

    4.17 The Ships are entirely non-smoking, except for specifically designated areas on the outside decks (this also applies to electronic cigarettes). The cabins and their private balconies, as well as the suite terraces, are non-smoking areas.

     – CHILDREN AND PREGNANCY

    5.1 Unaccompanied minors are not allowed on board. CDP authorizes minors, accompanied by a parent or a person with parental authority, or a person temporarily or permanently delegated to the custody of the minor, with the appropriate documentation, to board its ships from a certain age:

    –          From 1 year old on Yachting Cruises (all cruises, including those aboard the yacht “LE PONANT” and the catamaran “SPIRIT OF PONANT”, except for Expedition Cruises and cruises on board of LE COMMANDANT CHARCOT)

    –          From 6 years old on Expeditions Cruises

    –          From 8 years old on LE COMMANDANT CHARCOT Cruises

    5.2 For all Expedition Cruises, including those on board of LE COMMANDANT CHARCOT, children must be able to be completely autonomous during organized outdoor activities and when disembarking in inflatable boats, be of sufficient size to sit on the inflatable boats, and understand and respond immediately to orders given by those in charge. Consequently, children’s participation in any inflatable boat activity is subject to the agreement of the Captain and Expedition Manager, depending on sea conditions and the difficulty of disembarking at each site visited.

    5.3 Minors remain under full responsibility of their parents or the person with parental authority, or the person delegated to the custody of the minor when on board and/or on excursions. For safety reasons, it is not recommended to leave a minor alone and unsupervised in a cabin, whether during the day or at night. It is in fact recommended that the parent or the person with parental authority, or the person delegated to the custody of the minor share the cabin with a minor child.

    5.4 On Expedition Cruises, a maximum of five (5) children between the ages of 6 (8 for LE COMMANDANT CHARCOT) and 18 are allowed on board. CDP reserves the right to limit the number of children under the age of 8 on board its Ships.

    5.5 As the ships do not have facilities for giving birth on board, women who are more than 14 weeks of amenorrhea, i.e., 3 months’ pregnancy, are not allowed to embark on CDP’ ships. In any case, pregnant women under 14 weeks of amenorrhea, i.e., 3 months of pregnancy, travelling on board a Ship, are advised to consult a doctor before boarding to ensure that their medical condition is compatible with the scheduled Cruise and Itinerary. Pregnant women will not be allowed to embark on “Expedition Cruise” programs and/or on LE COMMANDANT CHARCOT.

    – CANCELLATION, INTERRUPTION OR CHANGE OF THE ITINERARY

    6.1 Any cancellation or interruption of the Cruise by the Passenger must be handled with by the Seller in accordance with the provisions of the contract between the Passenger and the Seller.

    6.2 The Carrier reserves the right to interrupt a Cruise, or to change its Itinerary, the port of call or destination, to delay or terminate the Cruise, to divert the Ship, to take or be taken in tow, to transship the Passengers and their luggage onto any other means of transport, if it deems it necessary at any time (i) for the comfort, health and safety of persons on board the Ship,  (ii) for the safety and security of the Ship and property, (iii) to save a life at sea, (iv) to preserve the environment, (v) to comply with applicable regulations and laws or in the event of orders issued by government authorities, or (vi) to maintain the good order of the Ship, (vii) in the event of a force majeure event,  (viii) in the event of adverse weather conditions, (ix) or as a result of a political, social or health situation in a country visited by the Ship. In any case, the Passenger will be informed of any cancellation or modification as soon as possible and will not be able to claim any compensation from CDP.

    6.3 The departure and arrival times of the Ship are provided for information purposes only and not definitive, and CDP cannot guarantee that they coincide with the connecting times (plane and train). CDP shall not be liable for the consequences of any delay, regardless of its nature. In any case, the dates and times of arrival at the ports of call, or the dates of the Ship’s call at certain locations are not contractual, and may be modified at any time, without notice, and without compensation.

    6.4 The Carrier may allocate Passengers cabins other than those originally planned. 6.5 The Ship may provide assistance to any person or property at sea or be diverted due to a medical emergency involving a Passenger or crew member and cannot be held responsible for the consequences of any alteration of the Cruise and/or Itinerary for this reason.

    – CARRIER’S LIABILITY

    7.1 The Carrier is liable to Passengers for injury, or death, or loss of luggage only and when they occur on board the Ship during the Cruise. CDP’s liability is governed by French law, according to the provisions and limitations of articles L. 5420-1 to L. 5421-12 of the Transport Code, by the provisions of (i) the London International Convention of 19 November 1976 as amended by its 1996 Protocol, and (ii) the Athens Convention relative to the carriage of passengers and their luggage by sea of 13 December 1974, as amended by its 2002 Protocol and, if applicable, by the provisions of Regulation 392/2009 of the European Parliament and of the Council. In any event, the Carrier may also invoke and benefit from the defenses, limitations and exclusions of liability available to carriers or subcontractors under international conventions and/or applicable laws or regulations.

    7.2 – Any claim by a Passenger other than for injury, death, or loss of luggage occurring during the Cruise must be addressed to the Seller and not to CDP which is not responsible for such claims.

     7.3 – CDP is not liable for immaterial damages, loss of use, special, indirect, exemplary, multiplied, consequential damages and punitive or similar damages.

    7.4 – Where a Passenger is not allowed to board the Ship or refuse to embark – including after or during a stopover – under the conditions set out in Articles 4 and 5, neither CDP, nor the Ship’s captain, nor can the crew be held liable in any way.

    7.5 The Carrier will under no circumstances be liable for injury, death, material or immaterial damage or consequential loss and/or (ii) damage arising from the interruption and/or modification of the Cruise caused by force majeure, war, blockade, riots, strikes, industrial disputes, acts of piracy or terrorism, epidemics or quarantines, natural disasters and catastrophes, merger nuclear meltdown, fission or pollution or explosion or its consequences, closure of the port of departure, call or destination; detention, requisition or seizure of the Ship for any reason whatsoever, use of the Ship for the special needs of the State, detention, requisition or seizure of the Ship for any reason, or by the mere threat of the above events. Nor is the Carrier liable for damage caused by the Passenger’s voluntary participation in a brawl or caused by a dangerous activity/action not made necessary by the need to safeguard human life.

    7.6 Luggage not claimed on arrival of the Ship will remain in port at the Passenger’s expense and risk.

    7.7 Unless specifically agreed in a written agreement, transportation services to the port of departure, water sports and scuba diving, as well as shore excursions, including hotel and restaurant reservations and guided tours, if any, even when booked from the Ship, are provided by independent service providers who are not representatives or employees of CDP or are provided by the Seller. Passengers use these services at their own risk. CDP does not assume or assume any liability for these services. Passengers will forward any complaints they may have regarding these services directly to the independent service providers or to the Seller.

    7.8 Claims for death, injury or loss of baggage occurring on board the Ship during the Cruise must be addressed to CDP by registered letter with acknowledgement of receipt accurately describing the incident and the alleged damage in an accurate and precise manner, no later than 15 working days from the end of the Cruise or the Passenger’s disembarkation, under penalty of foreclosure.

    7.9 Any action by the Passenger against the Carrier will be subject to limitation after one (1) year for property damage and two (2) years for personal injury, as from the date on which the Passenger disembarked or should have disembarked.

     – APPLICABLE LAW AND JURISDICTION

    8.1 These Maritime Conditions of Carriage are governed by French law.

    8.2 In the event of any dispute relating to the interpretation or performance of these Maritime Conditions of Carriage, it shall be referred to the competent French courts under French law.
